In the strict sense, admission is refused when the competent authority prevents the theory or practical test because a requirement is missing or has been denied. This is different from a failed test. After a test has been taken, the relevant issues are the result, reasons, examination record and repeat-test rules. The FSG treats professional competence and the driving test as parts of the procedure for issuing a driving entitlement. Under section 11 FSG, the test consists of a computer-based theory part and a practical part. The practical test may be taken only after the theory test has been passed. For the practical test, the passed theory, the minimum age for the requested category and a suitable test vehicle must also be considered. Section 10 FSG concerns professional competence. The driving school organises the test, while the authority remains responsible for the official procedure and allocation. Section 3(4) FSG-PV requires an authorised test centre to accept every candidate assigned by the authority, regardless of the driving school where the training took place. If the driving school only says that a document is missing or that no appointment is available, read the message carefully. A reviewable decision should identify the application, the requested category, the established fact and the legal basis. If the training confirmation is said to be missing, it should be clear whether it was never received or was received but not considered.
