File inspection in Austrian driving licence proceedings helps identify the reports, assessments and other records on which the authority relies. The request should identify the specific proceeding and must not be confused with an appeal.

Party status, the file number, the requested scope and any running appeal period must be reviewed separately. File inspection does not automatically postpone an appeal deadline. Keep the complete documents ready for prompt legal review.

File inspection requires party status in the proceeding

The right under section 17 AVG belongs to parties in relation to the records concerning their matter. Party status is governed by section 8 AVG: a legal claim or a legal interest in the matter is required. Mere knowledge of a proceeding or a general interest is not sufficient.

The request should therefore state the affected person, authority, file number and precise subject of the proceeding. In a driving licence matter, this may concern withdrawal, a restriction, an official medical question or an accompanying measure. The licence withdrawal focus area helps distinguish these subjects.

Three levels of file inspection

What may be inspected and what remains excluded

The right is broad but not unlimited. The relevant matter, statutory exceptions and the procedural stage all matter.

Section 17 AVG, section 17 VwGVG and section 21 VwGVG regulate different parts of the same review task.

Copies and electronic access must be requested separately

Under section 17(1) AVG, parties may make notes on site or arrange copies or printouts at their own expense. If the authority keeps the relevant record electronically, it may grant access in any technically possible form on request. This does not guarantee a particular delivery method in every proceeding.

State whether you seek an appointment, copies of identified parts or technically possible electronic access. Record the date of the request and keep the reply, appointment confirmation and transmitted files together. After receipt, check page numbering, schedules of enclosures and every assessment referred to in the decision.

The authority record shows the actual basis of the decision

Reading only the withdrawal decision may not be enough. Reports, records of interviews, proof of service, assessments, comments, requests for further documents and submissions may also matter. The specific record must show which documents are present and which material the authority used in its reasoning.

Exceptions must be separated from the complete record

Section 17(3) AVG excludes parts where inspection would harm legitimate interests of a party or third party, jeopardise the authority’s tasks or impair the purpose of the proceeding. The exception therefore concerns identified parts and does not by itself mean that no inspection is possible at all.

At the appeal stage, the AVG rules apply accordingly under section 17 VwGVG. Section 21 VwGVG additionally excludes draft court decisions and records of deliberations and votes. Parts lawfully excluded during the authority proceeding also remain excluded before the administrative court.

File inspection and the appeal period run separately

File inspection and an appeal against the decision are separate procedural steps. Section 7(4) VwGVG generally provides four weeks for an appeal against an authority decision. The date of service, legal remedy notice and deadline calculation must therefore be reviewed independently of the inspection appointment.

The driving licence record and criminal file remain separate

One traffic incident can lead to several proceedings. The inspection right in driving licence proceedings concerns the administrative record held by the competent authority. A criminal file held by the prosecutor or court follows different procedural rules. A request to one body therefore does not automatically provide access to the other body’s file.

  • copies or electronic files received in unchanged form
  • page numbering and schedule of enclosures with identified gaps
  • separate note on excluded parts of the record
  • running periods in a separate deadline list

Keep original files unchanged and use copies for annotations. This preserves what the authority supplied, which parts were missing or excluded and which documents were already available before the inspection request.
