An appeal against a driving licence decision requires more than reading the date on the first page and the legal-remedy notice. Check separately when and how the decision was served, what its operative part orders and how the authority gives reasons for its decision.

Section 7(4) VwGVG generally provides four weeks and links the start, for an appeal against a decision, to service. This article provides orientation for organising the decision and proof of service before legal review.

Legal basis and classification

Section 7(4) VwGVG generally provides a four-week period for an appeal against a decision. Under that provision, the period begins on the day of service. The date printed on the decision alone therefore does not establish a reliable final deadline. Without reviewing service and any further applicable procedural rules, this article does not state a binding final date. The legal basis is § 7 VwGVG.

Documents to review

Read the decision in four separate steps. Proof of service documents the possible starting point. The operative part states what the authority actually orders. The reasons set out the facts and legal considerations on which the order is based. The legal-remedy notice states the remedy, filing authority and period identified by the authority. Unclear or inconsistent information requires review, not assumptions. The glossary explains appeal and suspensive effect. Whether an appeal suspends enforcement in the particular proceeding cannot be inferred from section 7 VwGVG alone.
