A driving ban for a foreign licence holder in Austria is not always the same as the withdrawal of an Austrian driving entitlement. Where a foreign entitlement is concerned, the authority may prohibit its use in Austria. The decisive issues include normal residence, the specific withdrawal ground and the dates stated in the decision.

Do not examine the licence card alone. Arrange the decision, service record, residence evidence and issue records in one chronology. This shows whether an Austrian prohibition on use or a withdrawal procedure under section 30 FSG must be examined.

What prohibition on a foreign driving entitlement means

The prohibition under section 30 FSG concerns the right to use a foreign driving entitlement in Austria. It therefore answers an Austrian question first: may the person drive here with that entitlement? The foreign document is not automatically cancelled by the issuing state.

The applicable consequence depends on the actual residence and the dates in the complete decision.

Normal residence separates prohibition from withdrawal

Section 30(1) FSG concerns persons who do not have residence in Austria. Where a withdrawal ground exists, the authority may prohibit them from using the foreign entitlement in Austria. This is the typical Austrian driving ban for a foreign licence holder without normal residence here.

Where normal residence is in Austria, section 30(2) FSG refers to the withdrawal rules in sections 24 to 29 FSG. The measure is then not treated merely as a foreign-document issue. The guide to the competent driving authority explains which residence issues must also be organised.

Residence depends on personal and professional ties

The classification does not turn only on a registration address. Section 5 FSG links normal residence to actual personal and professional ties. If personal ties and employment are located in different states, the overall situation and actual stays must be assessed. The familiar 185-day reference is therefore not a substitute for a case-specific review.

Employment records, housing documents, family residence, length of stay and a temporary work assignment may explain the chronology. Place these records beside the period in which the foreign entitlement was issued or used in Austria.

The withdrawal ground must be traceable in the decision

A driving ban cannot be based solely on the presentation of a foreign card. The authority must connect the measure to a withdrawal ground under the Driving Licence Act and establish the relevant facts. The operative part and reasons of the actual decision are therefore central to the review.

Check which facts the authority relies on, which period the measure covers and whether the foreign entitlement is correctly identified. The Austrian prohibition does not automatically apply abroad

A prohibition under section 30 FSG regulates use of the foreign entitlement in Austria. It does not automatically mean that the issuing state withdraws the entitlement or that the same driving consequence applies there. Driving outside Austria requires a separate review of the law and decisions of that state.

In Austria, the person must not simply rely on the foreign card during the relevant period. Whether a foreign authority is also informed or opens its own procedure can only be assessed from the facts of the case and the rules that apply there.
