A withdrawal decision must be read as a complete case file. The decisive issue is how the operative part, reasons, assessment of traffic reliability, withdrawal period, accompanying measures and provable service fit together.

What the withdrawal decision actually determines

The operative part contains the binding order. It must show whether and to what extent the driving entitlement is withdrawn, the period stated, when that period begins and whether the authority orders an accompanying measure. The reasons should reveal the facts and legal assessment on which the authority relied.

Six points belong in one coherent review

This sequence prevents the period or a measure from being assessed without the corresponding operative part and reasons.

    Record the full operative part

    Copy the wording, scope and start of the withdrawal and every additional order without alteration.

    What matters is the authority’s binding order. A summary or covering letter does not replace the complete operative part.

    Match the reasons to the order

    Mark the facts, evidence and legal conclusions separately.

    The reasons show which facts the authority considers established and how it derives the requirements for withdrawal from them.

    Trace the traffic reliability assessment

    Identify the specific findings on which the authority bases its assessment.

    Section 7 FSG provides the statutory framework for traffic reliability. The decision must be read in the circumstances of the individual case; this article is neither an offence catalogue nor a case prognosis.

    Review step 4

    Record the period and its calculation

    Note the start, end and calculation basis used by the authority verbatim.

    Section 25 FSG governs the withdrawal period. A generic period calculator cannot determine whether the individual decision is legally sustainable.

    Review each accompanying measure separately

    Take the type, wording and any requirements only from the decision itself.

    Section 24 FSG also provides for accompanying measures. The individual decision determines what was ordered; this article makes no generic claim about providers or procedure.

    Document service in an evidential form

    Keep the envelope, proof of service, collection notice and actual receipt date together.

    Service belongs in the file because the legal-remedy notice and any deadline can be reviewed only with the actual service event. Keep the decision and proof of service ready for prompt legal review.

The three legal sources side by side

Section 7 FSG on traffic reliability provides the assessment framework. Section 24 FSG is the basis for withdrawal and accompanying measures. Section 25 FSG concerns the withdrawal period. A sound review requires both the current statutory text and the complete decision.

Separate provisional seizure, withdrawal and reinstatement

A provisional seizure under section 39 FSG and a later withdrawal decision answer different questions. The certificate records the immediate measure. The decision governs withdrawal or restriction, the period and any accompanying measures. Whether and when the licence can be returned or the entitlement reinstated depends on the procedural position and the statutory requirements.

Review service, legal-remedy notice and deadlines together

The proof of service records when and how the decision was delivered. Read the legal-remedy notice under section 61 AVG together with the service date. It identifies the intended remedy, authority, time limit and form. A remedy review therefore requires the complete decision and the service records.

Which part of the decision is binding? +
The operative part contains the binding order. The reasons, attachments and legal-remedy notice must nevertheless be available for a complete review.
Can the withdrawal period be calculated generically? +
No. Section 25 FSG and the individual decision must be reviewed together. A generic calculator cannot replace the authority’s case-specific assessment.
Which documents should I secure first if a deadline is running? +
Keep the complete decision, proof of service and all attachments together and arrange prompt legal review.
