A driving licence decision may contain a wrong number, date or designation. The first question is whether the authority should correct an obvious inaccuracy or whether the operative part, factual findings or legal assessment must be challenged.

Keep the complete decision, proof of service and the marked passage. A correction under section 62(4) AVG and an appeal serve different purposes. Any possible appeal period must therefore be reviewed independently of a correction request.

Classify the error in the driving licence decision first

Start with the operative part. It states the legal consequence ordered by the authority, such as withdrawal of the driving entitlement, its duration or a condition. The reasons explain which facts and considerations support that order. An error in the operative part therefore has a different significance from an inaccurate sentence in the reasons.

Compare the disputed passage with the rest of the decision, its enclosures and the authority record. The withdrawal decision check helps record the operative part, duration, service and accompanying measures.

When section 62(4) AVG permits a correction

Section 62(4) AVG covers clerical and calculation errors and other inaccuracies that are clearly based on an obvious mistake. The correct entry must be clear from the decision or from the procedure already established. A correction does not create a new factual basis and does not replace an assessment of evidence.

A plainly transposed number or date can therefore require a different response from an allegation that an event occurred differently or that a condition is legally impermissible. Identify the exact passage and explain why the correct entry is clear without new investigation.

Section 62(4) AVG concerns a narrow correction case. The operative part, reasons, service and remedy must also be reviewed.

Review the operative part, reasons and record separately

If the operative part names the wrong class, duration or condition, the discrepancy may directly affect the driving entitlement. An incorrect factual finding in the reasons requires comparison with reports, expert opinions, statements and other evidence. Withdrawal and its duration must be read in the context of the specific decision and section 24 FSG.

Keep correction and appeal as separate routes

A correction request seeks to remedy an obvious inaccuracy. An appeal challenges the decision and may concern the operative part, factual findings, assessment of evidence or legal reasoning. Whether an appeal is available follows from the specific decision and its remedy notice.

For decisions subject to administrative court review, section 7 VwGVG generally provides a four-week appeal period from service. Document service and the deadline immediately

Record when and how the decision was served. Keep the envelope, notice, electronic proof of service and the complete remedy notice. The date printed on the first page is not by itself a sufficient basis for a deadline review.

A correction request must not cause a possible appeal period to disappear from view. If the deadline is uncertain, have the decision and service records reviewed promptly. The withdrawal decision checklist helps collect the relevant documents.
