A licence issued in another EU or EEA state is generally recognised in Austria. After an earlier Austrian withdrawal, the card alone does not determine the outcome. Normal residence, issue date, reason for withdrawal and the end of the ordered period all matter.
Place the Austrian decision beside the foreign issue records. This chronology shows whether ordinary recognition, withdrawal under section 30(2) FSG or a prohibition on use for a person without Austrian residence requires review.

Section 1(4) FSG generally treats an EEA entitlement as equivalent. Article 2 of Directive 2006/126/EC also establishes mutual recognition, while Article 11(4) permits consequences where an entitlement has been restricted, suspended or withdrawn.

Where normal residence under section 5 FSG is in Austria, section 30(2) FSG provides for withdrawal of the foreign EEA or non-EEA entitlement under sections 24 to 29. Without Austrian residence, section 30(1) provides for a prohibition on using the foreign entitlement in Austria where withdrawal grounds exist.
The Administrative Court emphasised this distinction on 6 July 2020 in Ra 2018/11/0122. A registration address alone does not replace analysis of personal and professional ties.

Section 30(2) FSG expressly covers acquisition of a foreign entitlement while an Austrian withdrawal for lack of traffic reliability was already in force. The foreign entitlement is then withdrawn until the previously ordered period ends.

Section 30(2) FSG also provides for withdrawal where the foreign entitlement was acquired while normal residence was in Austria rather than the issuing state. The residence concept follows the driving licence directive and looks at personal and professional ties.
Collect more than registration papers. Employment, housing, family residence, actual stays and the purpose of a limited assignment abroad may all matter.

Expiry of a withdrawal period does not by itself prove that every foreign card may immediately be used without restriction. Later requirements, a longer period, finality of the decision and validity of the foreign entitlement require review.
