A driving licence decision may be served at an address outside Austria. For the start of an appeal period, the decisive points are the method used by the authority and the date on which service became legally effective.

Section 11 ZustG requires service abroad to comply with existing international agreements or with a route permitted by the law of the state where service is to take place. The proof of service therefore has to match the actual dispatch route, handover and date.

This article separates service abroad from the substantive question of withdrawing or restricting a driving entitlement under section 24 FSG. It explains which dates and documents should be secured for an initial review of service and the appeal period.

Service abroad requires a traceable service route

Under section 11(1) ZustG, service abroad must follow existing international agreements or a route permitted by the law of the state where service is to take place or by international practice. Austrian representative authorities may assist where necessary.

The first procedural questions are therefore specific: which method was used, which address received the document and which record proves delivery or another legally relevant form of access? A note saying that the decision was sent abroad does not answer these questions by itself.

The effectiveness of service and the content of the driving licence decision must be reviewed separately. Section 24 FSG concerns withdrawal or restriction of the driving entitlement. Whether an appeal period is running depends on effective service and the applicable procedural rule.

Two reviews, two document groups

Separate service from the decision itself

A reliable appeal-period review needs both the service records and the complete driving licence decision.

Keep the service process and the decision content distinct
Review area Core question Important records
Service route Was the route for the foreign address permitted and documented? Method, international basis, address and proof of service
Service date On which date did the decision become effectively served? Return receipt, electronic data, handover record or other proof
Decision Which withdrawal or restriction did the authority order? Complete decision, reasons and information on remedies under section 24 FSG

Sections 11 and 22 ZustG concern service and its proof; section 24 FSG concerns the driving licence measure.

The service date is the starting point for the appeal period

Section 7(4) VwGVG generally provides a four-week period for an appeal against an authority decision. Where the decision is served, section 7(4)(1) VwGVG links the start of that period to the day of service. The information on remedies and any special procedural rule must also be read carefully.

For service at a foreign address, the date in the proof of service should therefore be compared with the actual access and the method used. Reading the decision at a later time may raise a different issue from the legally relevant service date. Whether service was effective must be assessed from the documents and the applicable rule.

Anyone disputing service or relying on a different starting date should identify the concrete discrepancy: an unclear address, missing handover records, an unexplained route or dates that do not match across the decision and proof. General assumptions do not replace a review of the service process.

Document review

How to trace the appeal period

The review follows the documented service process while keeping the substantive decision review separate.

  1. 01
    Step 1

    Secure the complete decision

Do you have the full decision, reasons and information on remedies?

Keep every page, enclosure, envelope and electronic message. The measure under section 24 FSG can only be reviewed reliably from the complete version.

Legal reference points: Section 24 FSG, Section 7(4) VwGVG

  2. 02
    Step 2

    Identify the method and address

Which route and which foreign address were used?

Record the service method, address and basis for the route abroad. Section 11 ZustG connects service abroad with a permitted international or foreign route.

Legal reference points: Section 11 ZustG

  3. 03
    Step 3

    Read the proof of service

Which record shows the recipient and date?

Review the return receipt, service certificate, electronic service data or other handover record. Section 22 ZustG requires service to be certified.

Legal reference points: Section 22 ZustG

  4. 04
    Step 4

    Set out the dates

Which date is documented and which period applies?

Enter the documented service date and the resulting end date in a chronology. For an appeal against a decision, section 7(4) VwGVG generally provides four weeks.

Legal reference points: Section 7(4) VwGVG

  5. 05
    Step 5

Submit the complete file for review

Are the decision, proof of service and open questions together?

Combine the decision, service records and a short chronology. This allows the measure under section 24 FSG to be assessed separately from the question of the appeal period.

Legal reference points: Section 24 FSG, Sections 11 and 22 ZustG

The proof of service must match the actual event

Section 22 ZustG provides that service is certified on the proof of service. In a handover, the date and the person who accepted the document are among the relevant details. The form of the record varies with the method of service.

For an initial review, secure the complete return receipt or service certificate, the address used, the shipment or file number, any electronic service data and communications with the authority. Where a representative accepted the document, record who accepted it and in what capacity.

A proof of service records the documented event. It does not automatically answer every question about effectiveness in an individual case. If the address, recipient, date or route is unclear, describe the uncertainty precisely by reference to the original documents.

Document check

Are the service, appeal period and decision organised?

This check organises the documents around the service date. It does not replace a review of effectiveness or the appropriate remedy.

01 Question 1

Do you have the complete driving licence decision and information on remedies?

All paths at a glance

Overview of all answers.

01

The complete decision is still missing.

Secure the full decision, including reasons, information on remedies and enclosures. Without that version, the substantive and time-limit review remains incomplete.

Review the authority and procedure →
02

The service route or foreign address is not yet traceable.

Organise the route, exact address, shipment details and authority communications. For service abroad, the route used is material under section 11 ZustG.

Review authority and jurisdiction →
03

The proof of service does not clearly show the recipient or date.

Secure the return receipt, service certificate, electronic service data and other handover records. Note which entry is missing or inconsistent.

Review the appeal period →
04

The service date and appeal calculation are not yet connected in a chronology.

Record the method, documented service date, actual access and the period stated in the information on remedies. Review discrepancies against the original records.

Review the appeal period →
05

The key documents for the service process are organised.

Keep the decision, proof of service, route and chronology together. Effectiveness and the appropriate remedy still depend on the individual case.

Review decision and appeal period →

Keep these documents for the appeal-period review

  • complete driving licence decision with reasons, information on remedies and enclosures
  • envelope, return receipt, service certificate or electronic service data
  • foreign address used and any address-change records
  • shipment number, dispatch date, handover date and details of the accepting person
  • communications with the authority, delivery service or representative
  • your chronology showing service date, actual access and calculated end date

Organise the records so that route, service date and decision content remain identifiable. The information on medical assessments in driving licence proceedings and on the driving licence authority and its jurisdiction may help with the related procedural context.

FAQ

Frequently asked questions about service at a foreign address

Does the appeal period start when the decision is sent abroad? +
Dispatch alone does not determine the start. For an appeal against a decision, section 7(4) VwGVG generally makes the day of service decisive. The actual route and effective service date must therefore be reviewed for a foreign address.
How long is the appeal period against a driving licence decision? +
Section 7(4) VwGVG generally provides four weeks for an appeal against a decision. The information on remedies and any special procedural rule must also be checked.
What does section 11 ZustG mean for a foreign address? +
Section 11 ZustG requires service abroad to follow an existing international agreement or a route permitted by the law of the state of service. The records should make the route used traceable.
What does proof of service establish? +
Under section 22 ZustG, service is certified on the proof of service. Depending on the method, it may record handover, date, recipient or electronic service data. Its effect in the individual case requires review.
What should I do if service dates conflict? +
Secure the decision, information on remedies, service certificate, return receipt, envelope and electronic messages. Put the conflicting dates in a chronology and have the route and starting date assessed from the original records.
