A foreign authority is retaining an Austrian driving licence. The next steps for driving on and recovering the card depend on the reason for the measure, the country concerned and the exact wording of the records.

Section 14(3) FSG draws an important Austrian distinction: where a licence is taken abroad because of a fact referred to in section 7(3) FSG, the seizure is not treated as a missing document. A loss report with a temporary driving confirmation is therefore not a safe substitute.

What section 14 FSG distinguishes when a licence is taken abroad

A person who loses a driving document must report the loss without delay to the authority or the nearest public security service. The confirmation can permit driving until the new document is issued, but for no longer than eight weeks from the date on which the document went missing.

That rule concerns a missing document. The final sentence of section 14(3) FSG excludes a foreign seizure based on a fact referred to in section 7(3) FSG from that classification. The reason for the seizure is therefore decisive, not the fact that the card is currently unavailable.

Three starting points

Review possession of the card and driving entitlement separately

The retained card alone does not answer the legal question.

Distinguish seizure, driving ban and Austrian driving entitlement
Situation Question to review Key record
Foreign authority retains the card What reason and legal consequence are stated in the record? record, certificate or decision
The foreign measure prohibits further driving For which country, period and vehicle class does the prohibition apply? decision stating beginning, end and service
The Austrian entitlement still needs to be documented Which Austrian authority should classify the document status? Austrian register and authority record

The consequence depends on the foreign record and the current Austrian status.

Further driving depends on the foreign measure

The card may have been taken together with a separate driving ban, provisional seizure or further decision. A return instruction alone therefore does not establish permission to drive to the border or on to Austria.

Read the record for four points: does the measure apply only in the state of the check, does it prohibit driving, does it state a period and does it identify a remedy? The traffic rules of the foreign state and of any transit states remain relevant as well.

Which record to request from the foreign authority

Request a copy of the report, certificate or decision. It should identify the authority, date, person, licence details, reason for the seizure and place of custody.

The return process also needs clear information about the responsible office, collection or delivery, the period of custody and any remedy. If the classification remains unclear, ask the authority to confirm in writing whether it is retaining only the card or also prohibiting driving.

Case chronology

Four dates clarify the next decision

A complete chronology separates the check, seizure and return.

  1. 01
    Step 1

    Record the check

Note the place, date and foreign authority exactly.

Record the check and its reason from the written document. A spoken description such as seizure is not enough for classification.

Legal connection: section 14(3) FSG, foreign decision

  2. 02
    Step 2

    Review the reason for seizure

Compare legal basis, allegation and stated facts.

Check whether the record states a traffic or fitness-related fact and a specific legal consequence.

Legal connection: section 7(3) FSG, section 14(3) FSG

  3. 03
    Step 3

    Clarify driving on

Read the scope and period of any prohibition from the decision.

Only the foreign status shows whether further driving is permitted, restricted or prohibited.

Legal connection: foreign traffic rule, decision and service

  4. 04
    Step 4

    Document the return

Record custody office, return route and Austrian review.

Keep the return confirmation and all messages from the foreign authority for the Austrian status review.

Legal connection: return confirmation, Austrian authority record

Which records matter for the Austrian review

The foreign record, a copy or photograph of the licence, official photo identification and the Austrian entitlement data belong together. Add the recorded classes, periods of validity and conditions.

Arrange the documents by date: check, seizure, service, any remedy, return and contact with the Austrian driving licence authority. The guide to an Austrian withdrawal decision shows why the operative part, reasons and service must be read separately.

Keep return, replacement and document status separate

The return of the card and the Austrian driving entitlement are separate questions. The foreign custody office decides the return route. The Austrian authority classifies the status of the Austrian card and entitlement where that is required.

Do not immediately apply for a replacement document on the basis of loss when an authority has taken the card. The guide to a roadside measure and driving on helps distinguish the measure from its consequences. Where the foreign decision concerns the right to drive, also review the Austrian treatment of a foreign driving entitlement separately.

Document check

Is the foreign seizure documented for the next steps?

The check organises the reason for seizure, driving on and the return route.

01 Question 1

Do you have a written record of the foreign seizure?

All paths at a glance

Overview of all answers.

01

The written record of the foreign seizure is missing.

Request a copy of the report, certificate or decision with date and file reference.

Review seizure and decision →

Collect these records for the review

  • certificate, report or decision from the foreign authority
  • copy or photograph of the Austrian driving licence, where available
  • official photo identification and Austrian entitlement data
  • details of the check, seizure, service and any remedy
  • messages about driving on, custody and return
  • contact with the Austrian driving licence authority and its replies

The guide to provisional seizure helps separate the measure, the decision and the further review. For recognition and use of foreign documents, the guide to an EU licence after withdrawal is also relevant.

FAQ

Frequently asked questions about an Austrian licence seized abroad

Is a driving licence seized abroad treated as lost? +
Not automatically. Section 14(3) FSG expressly excludes a foreign seizure based on a fact referred to in section 7(3) FSG from the category of a missing document.
May I drive with an Austrian loss confirmation? +
Where the licence was seized abroad because of a relevant traffic or fitness-related fact, the loss rule cannot simply be used. The reason and legal consequence of the measure must be clarified first.
May I drive to the border after the seizure? +
That depends on the foreign decision and the rules of the transit states. An instruction about returning the card does not itself clarify permission to continue driving.
What record should I request from the foreign authority? +
Request a copy identifying the authority, date, licence details, reason, legal basis, period, custody office and return route. If driving is restricted, the written record should state that consequence as well.
Do I have to apply for a replacement licence in Austria immediately? +
A state seizure cannot be classified from possession of the card alone. Clarify the foreign measure first and submit the records to the Austrian driving licence authority.
