For a driving entitlement that is time limited for health reasons, the next medical appointment is not the only decisive point. The key question is whether the extension application was filed before the time limit expired and which confirmation the authority issued for that filing.
A pending extension does not automatically permit continued driving. Section 8 FSG sets narrow conditions. Review the expiry date, application, medical assessment, authority confirmation and every later decision together and arrange prompt legal review.
Under section 8(3) FSG, a medical assessment may confirm fitness to drive subject to conditions. It can then specify time limits, requirements, periodic medical examinations or other restrictions. Under section 8(3a) FSG, the duration of the time limit is calculated from the date on which the official medical assessment is issued.
Such a time limit must be distinguished from withdrawal. Section 24(1) FSG separates withdrawal from restrictions imposed through requirements, time limits and temporal, territorial or substantive limitations. A medical appointment by itself replaces neither the extension application nor the authority confirmation.

The complete decision, actual expiry date and current status of the extension procedure remain decisive.
Section 8(3a) FSG allows an extension application to be filed with an authority of the applicant’s choice within Austria. For the special driving provision, section 8(5) FSG expressly requires the application to have been filed before the time limit expired. An application filed only afterwards does not meet that condition.
Document receipt, not only the preparation of the application. Keep the application form, schedule of enclosures, proof of receipt and every request for additional records together. The official medical assessment checklist helps organise the assessment, reports and later authority correspondence.
Under section 8(5) FSG, a person may drive in Austria for no more than three further months after the time limit expires if the extension application was filed in time and timely extension was impossible through no fault of that person. These conditions must exist together. A procedure that is merely still pending is not sufficient by itself.
The provision applies only within Austria. It is not permission to drive abroad and does not create a new time limit for the licence. The entitlement also ends in any event when a decision refusing the extension is issued. Review every new letter immediately and do not rely on the originally assumed three month period.
The authority must issue confirmation that the application was filed in time. A person relying on section 8(5) FSG must carry that confirmation when driving. A medical appointment notice, a copy of an email or a payment receipt is not automatically the authority confirmation required by the statute.
Check the name, authority, application date, affected licence class and file number on the confirmation. If an item is missing or receipt is disputed, the document position should be clarified before driving. The glossary entry on the official medical assessment also helps distinguish the medical conclusion from the authority decision.
Under section 8(4) FSG, requirements on which the medical assessment makes fitness dependent must be observed. They may include specified aids or the regular submission of a specialist medical opinion. Filing the extension application in time does not remove those requirements.
Organise the time limit and each requirement separately. For every periodic examination, record which evidence the decision requires, who must issue it and when it must reach the authority. The medical assessment check creates a neutral preparation list but does not assess medical records or fitness to drive.
The check only organises records. It does not confirm a right to drive and does not replace review of the actual decision.
