If one stage of the second training phase is not completed on time, the authority does not immediately withdraw the driving entitlement. Section 4c FSG provides for an initial notice and proof periods. Only afterwards can an order, an extension of the probationary period and finally withdrawal of the affected entitlement follow.

The relevant facts are the class granted, the grant date, the missing training stage and the exact wording of the authority letter. The consequences are therefore distinct from a serious probationary-licence offence and from remedial training ordered for another reason.

The relevant provisions are section 4a FSG, section 4b FSG and section 4c FSG. Section 24(3) FSG also governs withdrawal until compliance.

What belongs to the second training phase

Section 4a FSG requires a second training phase after the first acquisition of class B or classes A1, A2 and A. Section 4b FSG sets the sequence and time windows. For class B, the stages are a perfection drive, a driving safety training with a traffic-psychological group discussion and a second perfection drive.

A pre-issued class B entitlement follows an adapted sequence. Classes A1, A2 and A have their own time windows and include hazard perception training. The providers record each stage in the driving licence register. Obtain confirmation for every stage and keep it with the authority letters.

The grant of the driving entitlement is the starting point for the deadlines. Booking a course is not the same as proving completion.

Section 4c(2) FSG uses fourteen months as the initial period for A1, A2 and A.

Which proof period applies to a missing stage

If one or more stages are not recorded within twelve months after the grant, the authority must issue a notice for class B. For A1, A2 and A, the relevant point is month fourteen. The notice explains the next steps: first there is a four-month period to provide proof. If the missing stage is still not proven, a further four-month period runs before the authority orders completion of the missing stage.

The periods are linked to the grant and to proof of completion. A booking or payment to a driving school is not proof. Check whether the certificate from the driving school or training provider exists and whether it was actually sent to the authority.

Withdrawal is the final stage of the statutory sequence. It generally lasts until the ordered training stage has been completed.

    The order extends the probationary period by applying section 4(3) FSG accordingly. It should identify the stage that must be completed.

    Withdrawal concerns the class for which the stage is missing. Under section 24(3) FSG, withdrawal of class B also affects the listed higher classes.

When the probationary period is extended

Once the authority orders completion of the missing stage, the probationary period is extended by applying section 4(3), second to fourth sentences, FSG. The decision and the driving licence register should make the affected class and entry clear.

This extension is a consequence of the incomplete training phase. It is not the same as the extension following a serious probationary-licence offence. Our article on a serious offence during the probationary period deals with that separate statutory sequence.

What withdrawal until proof means

If the order is not followed within the further period, the entitlement may be withdrawn until compliance. Section 24(3) FSG links this consequence to the failure to follow the order for the missing stage. It is therefore not a freely selected fixed withdrawal period like some other grounds for withdrawal.

Withdrawal generally concerns the class for which the stage is missing. Withdrawal of class B nevertheless also withdraws classes C, C1, CE, C1E, D, D1, DE and D1E. Check the operative part carefully and identify all dependent classes.

How to present special reasons for more time

Section 4c(2) FSG allows the authority, on application, to refrain from withdrawal for a reasonable period if particularly significant reasons are proven. The reasons must explain why the missing stage could not be completed within the period set.

Collect concrete evidence, such as documented illness, proven prevention or an impossibility caused by the authority or the organisation of the required training. A general statement that no appointment was available is not a substitute for a clear account of the circumstances. Submit the application with supporting documents before the announced consequence takes effect.
