Every matter is handled by a coordinated team of lawyers, legal staff and specialists. In driving licence cases we look at the file, deadlines and commercial consequences together.
A medically restricted driving entitlement can determine where, when or under which conditions you may drive. The decisive points are the specific medical finding, the operative part of the decision and the entry on the driving licence.
Section 8(3) FSG allows fitness to be confirmed conditionally or with restrictions. Section 24(1) FSG distinguishes withdrawal from a restriction through conditions, time limits and temporal, territorial or substantive restrictions. This article separates those levels and the control report required by the decision.
The medical report answers the medical question whether fitness is unrestricted, conditional, restricted or absent. Conditional or restricted fitness may require conditions, follow-up examinations, time limits or other restrictions.
A diagnosis alone does not describe the permitted driving scope. Read the finding together with the authority decision and the current licence. The medical assessment focus area explains the route from examination to decision.
The finding, decision and driving licence have different functions.
| Document | Core question | Review point |
|---|---|---|
| Medical finding | What level of medical fitness exists? | Conditions, controls and time limits |
| Decision with operative part | Which restriction does the authority order? | Class, area, time of day and control requirement |
| Driving licence | What is entered as the current entitlement? | Codes, expiry date and entries |
An entry must not extend beyond the specific decision and medical finding.
A territorial restriction concerns the permitted area. A temporal restriction concerns a period or time of day. Read the exact wording in the operative part. A general reference to medical reasons does not define the scope of the entitlement.
Also check which class and vehicle are affected. A restriction may concern one class only. A limitation for one vehicle does not automatically apply to every other class.
If the authority orders a follow-up examination or control report, the decision should show which examination is required and what consequence is linked to the evidence. An appointment alone does not prove that the required report is complete.
Arrange the finding, submission, control appointment and decision in chronological order. The medical assessment may concern the current situation, while an earlier condition or licence entry remains relevant. The current effective document record controls the scope.
The operative part determines what applies. The reasons explain the facts and medical considerations on which the authority relies. A restriction should therefore be traceable in the operative part by class, scope, start and, where applicable, control requirement.
If finding, reasons and operative part diverge, keep every page and attachment. The guide to the right to be heard and evidence helps classify the authority file.
A private confirmation or the view of a treating doctor does not automatically change an entry. The medical finding, authority decision and new licence entry must correspond before the restriction changes.
Until the change is clarified, drive within the limits shown by the current licence and decision. The page on record or withdrawal deals separately with another possible authority consequence.
The check organises the current decision and medical records.
