A demerit entry under section 30a FSG and withdrawal under section 24 FSG are different administrative consequences. A single keyword is not enough for classification. Read the heading, operative part and reasons together.

This article addresses only that distinction in the authority document. The demerit entries page explains the system itself. Keep the complete document and proof of service ready for legal review.

The heading provides an initial indication

Labels such as “demerit entry”, “notice” or “withdrawal of the driving entitlement” point in an initial direction. They do not decide the classification on their own. A document may use a general heading or cite several provisions in its reasons.

First organise the complete document. Record the authority, reference number, date, heading and attachments. Then turn to the operative part.

The operative part states what the authority orders

The operative part shows whether the authority withdraws or restricts the driving entitlement under section 24 FSG. Under section 30a FSG, the demerit entry is made after the court or administrative penal proceedings become final; the first-instance penal decision must contain a notice about the entry and its possible consequences.

Use the exact wording and the function of the passage. A notice about a demerit entry is not withdrawal ordered in the operative part. Conversely, a withdrawal decision does not become a mere demerit entry because its reasons also mention a demerit offence.

The reasons explain facts and legal basis

The reasons should show which facts the authority accepted and which legal basis supports the decision. References to section 30a FSG or section 24 FSG matter for the distinction, but they must correspond with the operative part.

Mark the findings of fact, the cited provisions and the connection between them. If that connection is missing, the operative part conflicts with the reasons or the consequence remains unclear, the complete document should be reviewed. Do not classify it from one statutory citation alone.
