Whether a probationary period applies to a foreign driving entitlement after moving to Austria depends on the date of the foreign grant and the start of residence in Austria. If residence is moved within three years after the grant, the probationary licence provisions apply. The three-year period runs from the foreign grant.

For an allegation during that period, keep the grant date, move of residence, date of conduct and authority decision separate. This article covers the special timeline under section 4(2) FSG and its consequences for a serious offence or a breach of the probationary alcohol rule.

Section 4(2) FSG links the probationary period to the foreign grant

Section 4(2) FSG covers people who move their residence to Austria within three years after their foreign driving entitlement was granted. The probationary licence provisions apply to that entitlement. The probationary period begins with the foreign grant and runs for three years from that date.

The move therefore does not start a new three-year probationary period under this special rule. The time already elapsed since the foreign grant remains relevant. The issuing state, the affected classes and recognition of the entitlement are separate questions. The article on converting foreign driving licences covers that different review focus.

Timeline

Which date relationship matters under section 4(2) FSG

The three key dates must be traceable from the records. An estimate of the move is not enough for classification.

Bring the foreign grant, move of residence and probationary period together
Foreign licence situation Effect on review Important records
Residence moved within three years after the foreign grant The timing requirement in section 4(2) FSG is met. The probationary period runs for three years from the foreign grant. Foreign licence, grant confirmation and records showing the start of residence
Residence moved only after those three years had elapsed The special timing requirement in section 4(2) FSG is not met on those dates. Other recognition or procedural questions require separate review. Grant date, residence chronology and records concerning the current entitlement
Grant date or residence date is unclear The start and end of the probationary period cannot yet be calculated reliably. Authority confirmation, residence records and dated evidence of the actual move

The foreign grant date and the legally relevant start of residence must appear in one chronology.

The grant date and residence start belong in one chronology

At least four dates must be distinguished: the foreign grant, the start of residence in Austria, the date of the alleged conduct and the order for remedial training. These dates cannot be replaced by the date of a later conversion or the issue of an Austrian card.

Section 4(2) refers to residence under section 5(1)(1) FSG. A registered address is therefore only one part of the review. Organise the actual circumstances of residence and the records that explain when it began. Where residences exist in several EEA states, the article on normal residence in the EEA helps draw the distinction.

A serious offence is reviewed separately during this probationary period

Section 4(3) FSG links remedial training to a serious offence under subsection (6) or to a breach of the special alcohol rule in subsection (7). Section 4(6) lists specific traffic offences, technically established speeding above the stated limits and certain criminal acts committed while driving. An arbitrary traffic violation therefore does not trigger remedial training merely because residence was moved.

The first timing question is whether the date of conduct still falls within the probationary period calculated from the foreign grant. Then review the allegation, the underlying penalty and any remedial training order separately. The article on a probationary licence after a serious offence explains the general sequence.

The remedial training order extends the calculated probationary period

When remedial training is ordered under section 4(3) FSG, the probationary period is extended by one further year. If the three-year period expired between the conduct and the order, a new probationary period of one year begins. The result therefore depends on the relationship between the date of conduct, the original end of probation and the order.

The residence authority reports the extension or restart to the driving licence register and records it on the licence. The probationary licence must be surrendered to the authority, which arranges production of a new licence. Remedial training and withdrawal of the driving entitlement are separate administrative consequences. Any additional withdrawal or restriction must be established from the relevant decision.

Are the foreign grant date and the start of residence in Austria documented?

All paths at a glance

Overview of all answers.

01

The relevant timeline is not yet fully documented.

Obtain dated confirmation of the foreign grant and organise the start of residence in Austria with the supporting records.

Prepare the residence chronology →
02

The timing requirement in section 4(2) FSG remains open.

Compare the grant date and residence start precisely. If residence began later, recognition and further procedural questions must be classified separately.

Distinguish recognition and conversion →

Keep these records for the timeline review

  • foreign licence showing both sides
  • confirmation or register extract showing the foreign grant
  • registration record and evidence of the start of residence in Austria
  • records concerning actual residence where there are several places of stay
  • police report, summary penalty notice, administrative penal decision or court decision concerning the allegation
  • service records and documents concerning finality
  • remedial training order with information on the probationary period
  • notice concerning the driving licence register and replacement licence
  • any withdrawal or restriction decision

Note the date, authority, file number and service for every document. This shows whether the conduct fell within the three-year period from the foreign grant and what consequence followed the later order.

FAQ

Frequently asked questions about a foreign entitlement and probation

Does the three-year probationary period restart when I move to Austria? +
Under section 4(2) FSG, the probationary period runs for three years from the grant of the foreign driving entitlement. A move within that period does not start a new three-year period under this special rule.
Does every traffic offence during this probationary period trigger remedial training? +
No. Section 4(3) FSG refers to serious offences under subsection (6) and breaches of the special alcohol rule under subsection (7). The actual allegation and procedural records require review.
What if residence was moved to Austria more than three years after the foreign grant? +
On those dates, the special timing requirement in section 4(2) FSG is not met. Recognition, conversion and other bases for an Austrian driving entitlement require separate classification.
When is the probationary period extended by one year? +
An order for remedial training under section 4(3) FSG extends it by one further year. If it expired between the conduct and the order, a new probationary period of one year begins.
