A driving licence decision can have legal consequences even if you did not personally receive the document. With deposited service, the notice, collection period and any temporary absence must be reviewed together.

Keep the notice, envelope, collection date and complete decision. § 17 ZustG governs deposited service; whether an appeal period has started depends on the actual service circumstances.

Deposited service and personal receipt are different events

A deposited document is held for collection at the designated office. The notice must therefore be kept with the decision collected later. Actual later knowledge does not automatically answer every question about the original service.

Record when the notice was placed, where the document was held and when it was collected. The appeal against the decision focus area helps separate service from the remedy.

Service review

Which document answers which deadline question?

Not every date in the file marks the same starting point.

Record service, collection and remedy separately
Document What it shows Do not assume
Notice of deposit Place, date and collection information That only collection creates legal effect
Envelope or service record Details of the document and service That a later telephone call replaces the record
Decision and remedy notice Remedy and stated period That the notice resolves every service question

§ 17 ZustG is only one part of the review; the actual service circumstances and decision remain decisive.

The collection period and appeal period need separate calculations

The service event, the start of the collection period and the remedy notice all matter. A general calculation without the notice and envelope is unreliable.

Use the appeal deadline check only for orientation. A possible missed deadline requires review of the original service documents.

Temporary absence must be supported by concrete records

An absence may matter to the effectiveness of deposited service. It is not enough to say that you were away; the timing and nature of the absence and the point of actual knowledge must be documented.

Keep travel records, hospital confirmations, work schedules or other contemporaneous evidence with the decision.

An appeal should not wait for file inspection

If the decision has been collected, deadline protection should not wait for file inspection. An appeal, file inspection and possible restoration of a deadline serve different purposes.

The article file inspection in driving licence proceedings explains the record review. Service documents still require separate assessment.

FAQ

Organise service and appeal together

Does the appeal period start only when a deposited decision is collected? +
That cannot be answered generally. The service event, deposit, absence, actual knowledge and decision must be assessed from the original records.
Which records matter most after a deposit? +
Keep the notice, envelope or service record, complete decision, remedy notice, collection record and evidence of any temporary absence.
Can I wait for file inspection before appealing? +
No. File inspection and an appeal are separate steps. Any possible appeal period must be protected independently.
