For a person with a physical disability, a particular adapted vehicle may be the basis for a restricted driving entitlement. The medical and technical questions then have to correspond: the medical report describes the physical impairment and the required compensation, while the technical assessment concerns the particular vehicle.

Section 9 FSG provides two specific instruments. A technical expert appointed by the authority assesses the construction and equipment of a particular vehicle when the medical report requires that question to be answered. If the report requires observation while the person operates the controls, an observation drive must be ordered before the medical report is prepared.

This article explains the sequence, the vehicle that may be used for the observation drive and the records required when the vehicle changes. Medical fitness and road safety depend on the specific finding, vehicle and proceedings.

The technical assessment concerns the particular adapted vehicle

Under section 8(3)(3) FSG, a medical report states “restricted fitness” where a person is fit to drive only a particular vehicle. The report must identify the physical impairments limiting fitness and the way in which those impairments can be compensated.

If that medical assessment requires technical expertise, section 9(1) FSG requires an assessment by a technical expert appointed by the authority. The issue is whether the construction and equipment of a particular vehicle compensate the physical impairments described in the medical report.

The technical assignment therefore concerns the identified vehicle and its equipment. A general statement that any vehicle with a similar conversion would be suitable does not answer this statutory question. For legal classification, the vehicle, conversion and medical requirement have to be read together.

Two assessments, two questions

Separate the medical and technical assessments

The two assessments complement each other but perform different tasks.

Assign the finding, compensation and vehicle separately
Assessment Core question What matters
Medical report Which physical impairment restricts fitness? Form of compensation and the statement “restricted fitness”
Technical assessment Does this particular vehicle compensate the impairment? Construction, equipment and technical conversions of the identified vehicle
Licence entry Which vehicles may be used within the entitlement? Registration plate, chassis number and prescribed technical conditions

Sections 8(3)(3) and 9 FSG connect the medical restriction with the particular vehicle.

The observation drive comes before the medical report

Under section 9(2) FSG, an observation drive must be ordered before the medical report is prepared if the report requires observation of the person operating the controls of a particular motor vehicle converted to compensate a physical disability. The drive therefore supplies a basis for the later medical assessment.

The sequence matters for the proceedings. The vehicle and the controls to be observed must first be identifiable. The drive is then carried out under the statutory conditions. The required technical conversions must be prescribed when the driving entitlement is granted.

An observation drive does not replace the medical report. A technical finding alone also does not answer the medical question which impairment exists and whether the identified equipment compensates it.

Procedural sequence

How the assessment of an adapted vehicle proceeds

Each step has its own function and builds on the preceding records.

  1. 01
    Step 1

Record the vehicle and the question

Which vehicle and which controls are to be assessed?

Keep the authority instruction, vehicle data and description of the physical impairment together. The technical and medical questions should be traceable from the file.

Legal reference points: Section 8(3)(3) FSG, Section 9(1) FSG

  2. 02
    Step 2

    Arrange the technical assessment

Does the medical report require a technical assessment?

If the construction and equipment of the particular vehicle have to be assessed, the authority must obtain the report of a technical expert appointed by the authority.

Legal reference points: Section 9(1) FSG

  3. 03
    Step 3

    Carry out the observation drive

Does the medical report require observation of the controls?

If that observation is required, the drive is ordered before the medical report. The vehicle must correspond to the class under consideration.

Legal reference points: Section 9(2) and (3) FSG

  4. 04
    Step 4

Read the medical report and conditions

Which impairment and which conversions follow from the result?

The medical report classifies the physical impairment and possible compensation. The required technical conversions must be prescribed when the driving entitlement is granted.

Legal reference points: Section 8(3)(3) FSG, Section 9(2) FSG

  5. 05
    Step 5

Correct vehicle data after a change

Does the new vehicle have technically corresponding conversions?

After a change, the authority may correct the registration plate and chassis number in the licence if an appointed expert confirms the corresponding technical conversions.

Legal reference points: Section 9(5) FSG

Which vehicle may be used for the observation drive

Section 9(3) FSG provides for a school vehicle of the relevant class as the standard case. The observation drive should therefore take place in a vehicle intended for the class under consideration and suitable for a safe assessment.

In special circumstances, another suitable vehicle of the relevant class may be used if there is no reason to fear a risk to traffic or operational safety. The provision refers in particular to people who already hold a driving entitlement. The mere availability of a private vehicle therefore does not automatically settle the question.

People whose medical report states “restricted fitness” must provide the corresponding adapted vehicle. Before the drive, the class, conversion and authority instruction should therefore be checked together.

Record conversions and a vehicle change in the licence

If the observation drive shows that the physical impairments are sufficiently compensated by one or more particular converted vehicles, section 9(5) FSG requires the registration plates and chassis numbers of those vehicles to be added to the medical report and noted in the driving licence.

A vehicle change therefore requires a documented comparison. The authority may correct the licence details if an expert appointed by the authority confirms that the technical conversions of the new vehicle correspond to those of the vehicles identified in the report. The technical equivalence must relate to the required compensation.

When a vehicle changes, read the existing report, the new equipment and the licence entry together. Until the documents correspond, the scope of the entitlement for the new vehicle remains unresolved.

Document check

Are the vehicle, reports and observation drive organised?

The check organises the records for the technical and medical assessment. Fitness and road safety remain questions for the competent proceedings.

01 Question 1

Do you have the complete authority instruction with attachments and the reference to the particular vehicle?

All paths at a glance

Overview of all answers.

01

The particular authority instruction is not yet organised completely.

Keep the instruction, every attachment and the details of the particular vehicle together. Mark which technical or medical question the authority has to answer.

Review official medical assessment →
02

The impairment and its compensation are not yet clearly assigned in the report.

Organise the medical report and the description of the physical impairment. The intended technical compensation should be readable together with the particular vehicle controls.

Review questions for the medical assessment →
03

The technical assessment, observation drive or vehicle class is not fully documented.

Compare the authority instruction, technical assessment and observation-drive order. Record which vehicle and class are to be used to assess the compensation.

Open the medical assessment check →
04

Vehicle data or licence entries are not yet traceable after a change.

Organise the previous and new vehicle, technical conversions, the expert confirmation and the licence entry together. This shows which record is still missing.

Open the medical assessment checklist →
05

The key records for the particular adapted vehicle are organised.

Keep the authority instruction, medical and technical reports, observation drive and vehicle data together. The effective documents and proceedings determine the specific entry and permitted use.

Review the assessment and decision together →

Keep these records for the assessment and drive

  • complete authority instruction with attachments and service information
  • medical report describing the physical impairment and possible compensation
  • technical report by the expert appointed by the authority where a technical assessment is required
  • order and record of the observation drive, including the vehicle class
  • vehicle documents, registration plate, chassis number and a traceable description of the conversions
  • driving licence with relevant entries and records concerning a vehicle change

Keep medical, technical and authority records separately and then combine them in one chronology. The medical assessment check supports the completeness review.

The questions for a medical assessment help prepare the appointment and identify open points.

FAQ

Questions about an adapted vehicle

When is a technical assessment needed for the converted vehicle? +
If the medical report requires a technical assessment, section 9(1) FSG requires a report by a technical expert appointed by the authority. It concerns the construction and equipment of the particular vehicle.
When does the observation drive take place? +
If the medical report requires observation while the person operates the controls of a particular vehicle converted to compensate a physical disability, section 9(2) FSG requires the observation drive to be ordered before the medical report is prepared.
Can the observation drive take place in a private vehicle? +
The standard case is a school vehicle of the relevant class. Another suitable vehicle may be used in special circumstances where no risk to traffic or operational safety is expected. The specific proceedings determine whether that condition is met.
What matters when the adapted vehicle changes? +
Under section 9(5) FSG, registration plates and chassis numbers must be traceable in the report and licence. After a change, the authority may correct the entries if an appointed expert confirms the corresponding technical conversions.
